1.By signing this Waiver and Release of Liability (Agreement), I waive and release Rustic RiverResort Ltd., its agents, servants, employees, insurers, successors and assigns from any and all claims, demands, causes of action, damages, or suits at law and equity of any kind, including but not limited to claims for personal injury, property damage, medical expenses, loss of services, on account of or in any way related to or growing out of my presence or involvement at the facility.
This waiver and release is intended to and does release Rustic River Resort Ltd. from any and all liability for damages or injuries on account of or in any way related to or growing out of my negligence, the negligence of third parties, and Rustic River Resort Ltd.’s negligence. This is not intended to release Rustic River Resort Ltd. from any liability resulting from their intentional conduct.
I further covenant and agree not to institute any claims or legal action against Rustic River Resort Ltd. for any claim released by this Agreement. I further agree that should any claim be made against Rustic River Resort Ltd. in contravention of this Agreement, including but not limited to derivative claims, I will protect, defend, and completely indemnify (reimburse) Rustic River Resort Ltd. for any such claim and expenses, including attorney’s fees and costs incurred by Rustic River Resort Ltd. in defending themselves or security indemnity hereunder.
2.I understand that Rustic River Resort Ltd. is not responsible for lost, stolen, or damaged valuables or property.
3.I acknowledge that I have read a copy of the rules and regulations governing the use of the facilities as listed on part 2 of this form and/or as posted at the pool. I agree that I will fully comply with all rules and regulations and with any amendments, including accompanying, supervising, and controlling of children ages 13 and under from the pool deck and being in the pool with any children under the age of 5.
4.I acknowledge that this pool does not have lifeguards on duty at any time and that is my duty to watch the children and young persons under my care
I have read the Agreement and understand that by signing the Agreement I have consented to be bound by its terms, including the waiver/release of any legal right I may have to sue Rustic River Resort Ltd. For any costs they incur because a claim or legal action is brought in violation of this Agreement. I agree any breach/violation of the Agreement and its terms and conditions, as determined by Rustic River Resort Ltd., will void and terminate this Agreement and may result in loss of the ability to use the facility. I am signing this Agreement freely, voluntarily, and competently, and am at least eighteen (18) years of age.

THE RULES:

1. Bathers must take a shower using soap prior to entering the public swimming pool.
   2. Patrons must wash their hands using soap after using the washroom or changing diapers.
   3. Glass is prohibited on the pool deck or in any pool area.
   4. Street footwear must not be worn in wet traffic areas.
   5. Patrons who are intoxicated will not be allowed to use the pool.
   6. The maximum bather load for the public swimming pool is 132 people.
   7. The public swimming pool depth is maximum of .75 of a meter in all areas of the pool
   8. Diving is not allowed in any part of the pool.
   9. Use of slide or floating toys at risk of patron; all children using toys are to be supervised by an adult.
   10. No diving, stunting, jumping, somersaults, running, or other unsafe behavior in the pool, pool deck or on pool inflatables.
   11. No food or drinks in the pool
   12. Children aged 13 and younger must be accompanied by an Adult AND SUPERVISED BY AN ADULT WHILE IN THE POOL OR POOL AREA. Parents/guardians must go into the pool with children 5 years and under.
   13. Children who are not Toilet Trained and/or children 35 months and under must wear POOLDIAPERS
   14. ENTER AND EXIT the pool ONLY by the steps - DO NOT climb over the sides!
   15. Be respectful and wait your turn – do not push or shove other children, and do not cut in lines.
   16. Do NOT use the pool if you have communicable diseases or infectious conditions.
   17. Do NOT use the pool under the influence of alcohol or drugs.
   18. Behaviour such as spitting or spouting water, roughness, rowdiness, blowing noises, and shooting water guns is NOT permitted.
   19. Profanity or indecent language will not be tolerated.
   20. NO more than 10 people at the top of Bob the Builder Slide.
   21. No more than 1 person can use Bob the Builder Slide at once.
   22. No person shall cause willful damage to the facility.
   23. No footwear is allowed in the pool.
   24. Bathing attire must be clean, safe, and appropriate.
   25. Permits are required for pool access, and permits are NON-TRANSFERABLE.
   26. SWIM AT YOUR OWN RISK - NO LIFEGUARDS ON DUTY.
   Violation of the rules will result in expulsion from the pool with no refund of any fees paid.
